Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of onsavo.com and any related pages, features, content, and services (collectively, the "Platform"), operated by [ONSAVO LEGAL ENTITY] ("Onsavo," "we," "us," or "our"). Please read these Terms carefully before using the Platform. By accessing or using the Platform, creating an account, completing a health questionnaire, or purchasing a subscription, you agree to be bound by these Terms.

1. Acceptance of These Terms

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Refund & Cancellation Policy, and any other policies referenced here, each of which is incorporated by reference. If you do not agree to these Terms, do not access or use the Platform.

If you are using the Platform on behalf of another person, you represent that you are authorized to accept these Terms on that person's behalf. We may update these Terms from time to time as described in Section 13. Your continued use of the Platform after an update means you accept the revised Terms.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age;
  • Be a resident of, and physically located in, the United States at the time of any consultation or order; and
  • Reside in one of the states where our services are currently available: [STATES SERVED].

The Platform is not directed to, and may not be used by, anyone under 18. We do not knowingly collect information from minors. Services may not be available in all states, and the availability of specific products or independent providers may vary by location. We may verify your eligibility and may decline service, suspend, or terminate access if you do not meet these requirements or provide inaccurate information.

3. Description of the Service

Onsavo operates a technology and marketing platform that connects users with independent, state-licensed healthcare providers affiliated with [AFFILIATED MEDICAL GROUP] for telemedicine consultations, and with [COMPOUNDING PHARMACY] for the dispensing of any medications that may be prescribed.

Onsavo is not a medical practice, a pharmacy, or a provider of healthcare services. Onsavo does not practice medicine, does not practice pharmacy, and does not prescribe, dispense, or sell medications. We do not make medical decisions, and we do not control or direct the clinical judgment of any provider.

The independent providers affiliated with [AFFILIATED MEDICAL GROUP] are solely responsible for all clinical care, evaluations, diagnoses, treatment decisions, and prescriptions. [COMPOUNDING PHARMACY] is solely responsible for compounding, dispensing, and shipping any prescribed medications. These parties are independent of Onsavo and exercise their own professional judgment. Onsavo's role is limited to providing the technology platform, facilitating communication and scheduling, processing payments and subscriptions, and providing non-clinical administrative support.

4. Medical Disclaimer

The Platform is not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use the Platform for urgent or emergency medical needs.

The Platform and any information provided through it are not a substitute for in-person medical care, examination, diagnosis, or treatment. Telemedicine has limitations, and an independent provider may determine that your condition is not appropriate for treatment via telemedicine and may recommend that you seek in-person care.

Using the Platform does not create a provider-patient relationship with Onsavo. Any provider-patient relationship is formed solely between you and an independent licensed provider affiliated with [AFFILIATED MEDICAL GROUP], not with Onsavo. Onsavo does not provide medical advice, and nothing on the Platform should be interpreted as medical advice from Onsavo. Always seek the advice of a qualified healthcare professional with any questions about a medical condition, and never disregard professional medical advice or delay seeking it because of something you read on the Platform.

5. Telemedicine Consultations and Consent

When you request services, you may be asked to complete a health questionnaire and provide information including your height, weight, body mass index (BMI), medical history, and other health details. An independent licensed provider affiliated with [AFFILIATED MEDICAL GROUP] will review your information through a telemedicine consultation.

By using the Platform, you acknowledge and agree that:

  • A consultation will be conducted using telecommunications technology rather than an in-person visit, and you consent to receiving care via telemedicine where permitted by your state;
  • The accuracy and completeness of any evaluation depend on the accuracy and completeness of the information you provide;
  • The decision to prescribe any medication or treatment, or to decline to do so, is made at the sole discretion of the independent provider following the consultation. A purchase, subscription, or completed questionnaire does not guarantee that any medication or treatment will be prescribed;
  • A provider may determine that a requested product is not appropriate for you and may recommend an alternative or no treatment; and
  • You should review and complete any separate telehealth informed-consent document presented to you, which governs the clinical aspects of your care.

If a provider determines that treatment is not appropriate, no prescription will be issued, and any applicable charges will be handled in accordance with our Refund & Cancellation Policy.

6. Compounded Medications and Dispensing

Many of the products available through providers on the Platform — including certain compounded GLP-1 weight management, compounded NAD+, peptide, testosterone, hair, and hormone support products — are compounded medications prepared by a compounding pharmacy.

Compounded medications are not FDA-approved and have not been reviewed by the FDA for safety, effectiveness, or quality. Compounded medications are prepared by a licensed pharmacy for an individual patient based on a prescription from a licensed provider. They are not commercially available branded products, and they are not equivalent to, or substitutes for, any FDA-approved branded medication.

If an independent provider prescribes a compounded medication, it will be compounded and dispensed by [COMPOUNDING PHARMACY], a 503A and/or 503B pharmacy (LegitScript-certified or NABP-accredited). Onsavo does not compound, dispense, ship, or sell medications. All clinical decisions about whether a compounded medication is appropriate for you rest solely with your independent provider. Where testosterone or other programs involve laboratory testing, at-home CLIA-certified lab testing may be provided through [CLIA LAB PARTNER].

7. Subscriptions, Billing, and Auto-Renewal

Certain services and products are offered on a subscription basis. By enrolling in a subscription, you authorize us (or our payment processor) to charge your selected payment method on a recurring basis.

  • Monthly billing. Subscriptions are billed monthly and automatically renew each month until canceled. Each month, your payment method on file will be charged the applicable subscription fee.
  • Same Price at Every Dose. Subscription pricing is offered as "Same Price at Every Dose," meaning the monthly subscription price for a given program does not change based on the dose your provider prescribes.
  • Authorization. You authorize recurring monthly charges and agree to keep your payment and contact information accurate and up to date. If a payment fails, we may retry the charge or suspend your subscription.
  • Cancellation. You may cancel your subscription at any time. To avoid being charged for the next billing cycle, you must cancel at least [X] days before your next monthly billing date. If you cancel after that point, the cancellation takes effect at the end of the current billing cycle, and you will not be charged for the following month.
  • No guarantee of fulfillment. A subscription charge does not guarantee that any medication will be prescribed or dispensed; all prescriptions remain subject to the independent provider's clinical judgment (see Section 5).

Fulfillment of any subscription is contingent on a valid prescription from an independent provider. For full details on refunds, cancellations, and how charges are handled when treatment is declined, see our Refund & Cancellation Policy, which is incorporated into these Terms by reference.

8. Acceptable Use and Account Responsibilities

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree that you will:

  • Provide accurate, current, and complete information about yourself and your health, and promptly update that information as needed;
  • Use the Platform only for your own personal use and not on behalf of any other person;
  • Maintain the confidentiality of your account credentials and be responsible for all activity under your account;
  • Not share, resell, or transfer any medication prescribed to you, and not request medications for anyone other than yourself; and
  • Not misuse the Platform, attempt to gain unauthorized access, interfere with its operation, upload malicious code, scrape or harvest data, or use it in any way that violates applicable law.

You are responsible for the accuracy of the health information you provide. Providing false, incomplete, or misleading information may result in inappropriate or unsafe treatment recommendations, may cause a provider to decline service, and may result in suspension or termination of your account. We reserve the right to suspend or terminate access for any violation of these Terms.

9. Intellectual Property

The Platform and all content on it — including text, graphics, logos, images, page layouts, software, and the "Onsavo" name and marks — are owned by or licensed to [ONSAVO LEGAL ENTITY] and are protected by intellectual property and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use in accordance with these Terms.

You may not copy, reproduce, modify, distribute, publicly display, create derivative works from, or otherwise exploit any part of the Platform without our prior written permission. Any unauthorized use terminates the license granted above. All rights not expressly granted are reserved.

10. Disclaimers of Warranties and Limitation of Liability

Disclaimer of warranties. The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Onsavo disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful components, or that any particular medical outcome will result from using the Platform. Onsavo makes no warranties regarding the services of any independent provider, [AFFILIATED MEDICAL GROUP], [COMPOUNDING PHARMACY], or [CLIA LAB PARTNER], each of whom is independent of Onsavo and solely responsible for its own services.

Limitation of liability. To the fullest extent permitted by law, in no event will Onsavo or its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Platform, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages. To the fullest extent permitted by law, Onsavo's total aggregate liability for all claims arising out of or relating to the Platform or these Terms will not exceed the greater of (a) the total amount you paid to Onsavo in the three (3) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. Because Onsavo does not provide medical care, this section does not address the professional responsibility of any independent provider or pharmacy, which is governed by their own agreements with you and by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless [ONSAVO LEGAL ENTITY] and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms or any applicable law; (c) any health or personal information you provide that is false, inaccurate, or incomplete; or (d) your misuse of any medication or product. This obligation survives termination of your account and these Terms.

12. Governing Law, Dispute Resolution, and Severability

Governing law. These Terms are governed by and construed in accordance with the laws of the State of [GOVERNING-LAW STATE], without regard to its conflict-of-laws principles.

Arbitration agreement. Please read this section carefully, as it affects your legal rights. Except as otherwise provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court. Arbitration will take place in [GOVERNING-LAW STATE] unless you and Onsavo agree otherwise, and judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and Onsavo agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a class proceeding.

Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information. Nothing in this section prevents you from contacting Onsavo to attempt to resolve a dispute informally first, which we encourage.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. If the class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court rather than in arbitration.

13. Changes to These Terms

We may modify these Terms from time to time. When we do, we will revise the effective date below and, where appropriate, provide additional notice. Changes are effective when posted. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and may cancel any active subscription in accordance with Section 7.
